By accessing or using SecureMerchant's payment processing services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
Merchant Account Requirements
To use our services, you must:
- Be a legally registered business entity
- Provide accurate and complete information during application
- Maintain compliance with all applicable laws and regulations
- Operate a legitimate business in an approved industry
- Have a valid business bank account
Fees and Pricing
You agree to pay all fees associated with your merchant account as outlined in your pricing agreement. Fees include transaction fees, processing fees, and any applicable chargeback fees. We reserve the right to modify our fees with 30 days' notice.
Prohibited Activities
You may not use our services to:
- Process fraudulent or illegal transactions
- Violate any laws or regulations
- Engage in money laundering or terrorist financing
- Process transactions for prohibited goods or services
- Misrepresent your business or products
Chargebacks and Disputes
You are responsible for all chargebacks and disputes related to your transactions. We may deduct chargeback amounts and fees from your account balance or future settlements. Excessive chargebacks may result in account termination.
Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms, excessive chargebacks, fraudulent activity, or any other reason at our discretion. You may also terminate your account at any time with written notice.
Limitation of Liability
To the maximum extent permitted by law, SecureMerchant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Changes to Terms
We may modify these Terms of Service at any time. We will notify you of material changes via email or through your account dashboard. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
